3.1. 차별금지법 관련 발언 및 성소수자 혐오 논란
안창호 당시 인권위원장 후보자가 "동성애는 자유지만 다른 사람에게 피해를 줘선 안 된다", "차별금지법이 도입되면 에이즈가 확산된다" 등의 발언으로 성소수자 혐오 논란이 일었다. # # # 심지어 이를 문화적 마르크스주의로 간주하는 발언까지 했다.#[1]그는 포괄적 차별금지법에 대해 안토니오 그람시의 주장을 근거로 들며 "공산주의 혁명으로 가는 긴 행진의 수단"이라고 주장했다. # # 후보자가 언급한 그람시와 20세기 초에 등장한 신마르크스주의자들은 단 한 번도 소수 성애를 사회주의 · 공산주의 혁명의 중요한 수단으로 간주한 적이 없다. 비슷한 시기에 공산 혁명을 성공시켜 인류 최초로 사회주의 국가를 수립한 볼셰비키와 사회혁명당 좌파는 물론, 그들과 의견이 달랐던 멘셰비키와 사회혁명당 우파들도 그러한 주장을 하거나 그런 노선을 추구한 적이 단 한 번도 없다.
그나마 그의 발언과 관련되어 있다고 볼 수 있는 집단은 알렉산드라 콜론타이, 이네사 아르망 같은 러시아의 여성 혁명가들과 냉전 시대에 태동한 신좌파인데 전자에게 소수 성애는 혁명의 수단이 아니라 혁명 이후에 그 존재를 인정하고 권리를 보장해야 하는 개념이었고 후자 역시 소수 성애를 혁명의 중요한 수단으로 보지 않았다. 따라서 그의 발언은 역사적 근거가 전혀 없는 말이다. 동성애와 공산주의가 종교와 대치한다는 이유로 공공의 적으로 생각하는 개신교 근본주의의 왜곡인 셈이다.
또한 본인이 저술한 책에서 차별금지법이 도입되면 "에이즈·항문암·A형 간염 같은 질병 확산을 가져올 수 있다"[2], "신체 노출과 그에 따른 성 충동으로 인한 성범죄 급증할 수 있다"는 등의 내용이 담겨 있는 것도 파장이 일었다.
안창호의 주장에 대해 학계에선 "혐오 표현에 가까운 주장에 불과하다"는 평이 나오는데, 한 보건학 교수는 "감염병 원인을 모르던 1980년대에나 할 법한 비합리적인 말을 2024년에 한다는 것이 놀랍다"며 "논리가 없어 오히려 반박이 힘들 정도"라고 말했다. 또한 인간면역결핍 바이러스를 예방·통제하는 데 있어서 "환자에 대한 낙인효과를 줄이는 게 중요하다"는 학계 정설과 안창호의 주장은 배치된다. 안창호가 동성애와 질병 연관성을 주장한 근거로 인용한 미국 질병통제예방센터는 "HIV 낙인·동성애 혐오·차별·빈곤 등의 사회·구조적 문제가 건강에 영향을 미치고 불평등을 유발한다"고 분석한다. #
장혜영 전 정의당 의원은 "안창호 인권위원장의 임명을 강행하면 세계적 웃음거리 될 것"이라고 발언하기도 했으며[3] 각계에서 비판이 거세게 인 후 그가 차별금지법 제정에 반대하는 개신교계 단체인 복음법률가회를 탈퇴했다는 기사가 보도되었다.#
3.1.1. 진화론 부정 개신교 근본주의적 주장 논란
"진화론은 하나님의 창조를 믿기 싫어 만들어낸 가설에 불과하니 배울 필요가 없다"는 발언으로 사실상의 창조론을 주장해 독실한 수준을 넘어 개신교 근본주의에 기반한 맹목적이고 반지성주의적인 종교적 신념을 드러내 논란이 되었다.
개신교 모태신앙이자 목사의 아들인 천하람 개혁신당 의원은 "우리 과학계에서 들으면 기절초풍할 이야기고, 상식의 영역에 들어와 있지 않다”며 “윤석열 정부의 인사의 대체적인 특성들인데, 상식적이고 합리적인 범주를 넘어선 분들이 많다”고 비판했다.#
김성회[4] 더불어민주당 의원의 지구의 나이가 46억 년이 맞냐는 질문에 답변을 거부하고 과학이 아닌 신앙과 믿음의 문제라고 생각한다고 답변하였다.# 그런데 같은 질의에서 에이즈는 동성애자와 상관관계가 있다고 과학적으로 주장할 수 있어야 한다는 모순을 보여주었다.
인권 시민사회 단체들이 인사청문회 과정에서 드러난 그의 특정 종교 편향(親개신교), 사회적 소수자 차별, 자질 논란 등을 비판하며 자진사퇴를 촉구했다.#
3.2. 헌법재판관 시절 부부동반 출장 의혹
2024년 9월, 서미화 더불어민주당 의원실에 따르면 그는 2014년 브라질, 아르헨티나, 페루 대법원 방문 목적으로 공무 출장을 갔는데 출입국 내역에 그의 배우자도 같은 기간 동반 출국한 것으로 확인되었다. #2015년과 2017년 등 독일, 벨기에, 스위스, 포르투갈 등 방문 시에도 부부의 출입국 내역이 일치한 것으로 확인되어 논란이 일었다.#
그러나 인사청문회 과정에서 그가 국외 출장에 가족을 동반하지 않았다는 내용의 문건은 헌법재판소에서 회신한 자료임이 확인되었다. 헌법재판소는 그의 부인에 대한 출장비용 지출이 없었으므로 '가족 동반여부: 해당없음'으로 표기해 회신한 것으로 보인다.#

4.1. 국정감사 보고서 부정 논란

해당 안건의 경우 탄핵 심판 심리에서 방어권을 철저히 보장하라며, 계엄 관련 형사 소송이 끝날 때까지 심판을 중지해야 한다는 주장을 하면서 반대로 공수처와 국수본 등의 수사기관에게 체포와 구속영장 청구를 하지 않을 것을 권고했다. 또한 탄핵 심판과 관련하여 헌법재판관 임명 업무의 태만 및 거부로 탄핵당한 한덕수 국무총리의 탄핵을 철회하여 윤석열에게 힘을 쏟도록 하는 안건 위주인데, 이로 인해 인권위원회를 윤석열의 보호를 위해 남용하는 게 아니냐는 비판을 받았다.
이에 본인은 비상계엄 사태의 중함을 고려하여 판단한 것이라고 밝히면서 그 과정에서 계엄에 실패했으니 논란이 될 만한 요소는 아니라는 윤석열 측의 논리를 답습한 것이었다. 또 해당 안건 상정을 강행하는 행보를 드러냈고, 이로 인해 인권위 노조 측과 야당 등의 거센 비판과 함께 인권위 전원의 탄핵소추 및 권력 남용죄로 고발한다는 조치를 취할 것을 밝혔으며 사세행 측이 먼저 안창호를 필두로 방어권 안건을 상정하려 한 6명을 공수처에 직권남용죄로 고발 조치를 취했다.
4.3. 서부지법 폭동 옹호 논란
“서부지법 폭동 70명이 구속되는 인권 문제 발생”...안창호 특별심사 요청 답변서 전문 살펴보니서부지법 폭동을 옹호하는 답변서를 작성해 비판받았다. 국내 시민단체 등이 세계국제인권기구연합에 한국 인권위를 특별심사해달라고 요청하자 안창호 국가인권위원장이 직접 답변서를 보냈는데, 그 내용 중 "법원의 공정성과 적법성에 의문을 가진 사람이 자살하고 법원 폭력 사태로 70명이 구속되는 인권 문제가 발생했다"라는 주장이 담겨있었다. 법원 폭동 사태 등을 사법부 탓으로 돌리고, 폭동 가담자들이 구속된 걸 인권 문제라고 칭한 것이다.
4.4. 여성 비하 및 성희롱 발언 논란
“여성은 무능, 승진은 독해서" 안창호 인권위원장의 충격적 여성관"안창호, '여성 승진 누락은 유리천장 아닌 무능해서' 비하 발언"
안창호 위원장이 인권위 직원들에게 “여성이 승진을 못 하는 것은 유리천장 때문이 아니라 무능해서 그렇다” 등 문제적 발언을 일삼았다는 내부 폭로가 나왔다. 인권위 노조가 직원들로부터 제보를 받은 결과다. 한 시민단체는 안 위원장 언행을 문제 삼아 공수처에 고발하고 인권위에 진정서를 제출했다.
문정호 전국공무원노조 인권위 지부장은 8월 4일 MBC 라디오 ‘김종배의 시선집중’ 인터뷰에서 “안 위원장의 부적절 언행에 대한 제보가 늘고 일부 인권위원들의 행적과 언행에 대한 논란이 이어져 7월 29일부터 내부망 게시판을 통해 제보를 받기 시작했다”며 “현재까지 130여 건의 댓글이 달렸고 구체적인 제보는 40여 건으로 추정하고 있다. 또한 그 중에는 성희롱과 여성 비하 발언 등이 포함되어 있다"고 밝혔다.
제보 내용에 따르면 안 위원장이 “여성들이 전통적으로 집안일이나 돌봄에 특화돼서 능력을 개발하지 못했기 때문에 승진을 못 한 것”이라고 한 적이 있다고 한다. “승진을 못 하는 것은 유리천장 때문이 아니라 무능해서 그렇다” “고위직으로 올라간 여성들은 독해서 그렇다” 등의 문제적 발언을 했다는 제보도 접수됐다.
문 지부장은 “(안 위원장이) 특정 국가기관에 있는 여성을 거론하면서 '여성이 일을 잘해서 승진한 게 아니라 일을 못해서 승진을 하는 거다'라는 식으로도 말했다”며 “인정을 받아 승진한 것이 아니라, 그 사람이 승진을 안 하면 밑의 직원들이 승진을 못 하기 때문에 그랬다는 맥락으로 이해된다”고 설명했다.
이런 발언의 상당수는 안 위원장이 점심시간에 여성 직원들과 식사하거나 특정 인권 이슈에 대해 보고받는 과정에서 나온 것으로 조사됐다. 문 지부장은 “직원들은 여성에 대해 이런 인식을 가진 분이 어떻게 인권위원장으로 있는지를 이해할 수 없다는 분노를 많이 표출했다”고 말했다.
이 발언으로 인해, 안창호 헌법재판관이 사실 박근혜를
인권침해로 인권위에 진정을 당했다.#
11월 5일 국회 국정감사에서 해당 의혹을 전부 부인했다.
