1. 개요

강도죄를 저지른 자가 살인죄도 저지른 경우의 죄책이다. 강학상 강도살인치사죄의 한 종류이다. 대한민국 형법 제338조에 강도치사죄와 함께 규정되어 있다.

2. 법조문

제338조(강도살인·치사) 강도가 사람을 살해한 때에는 사형 또는 무기징역에 처한다. 사망에 이르게 한 때에는 무기 또는 10년 이상의 징역에 처한다.

2.1. 특례법에 의한 가중처벌

항공보안법 제40조(항공기 납치죄 등)[1]
① 폭행, 협박 또는 그 밖의 방법으로 항공기를 강탈하거나 그 운항을 강제한 사람은 무기 또는 7년 이상의 징역에 처한다.[2]
② 제1항의 죄를 범하여 사람을 사상(死傷)에 이르게 한 사람은 사형 또는 무기징역에 처한다.[3]
③ 제1항의 미수범은 처벌한다.
④ 제1항 또는 제2항의 죄를 범할 목적으로 예비 또는 음모한 사람은 5년 이하의 징역에 처한다.[4] 다만, 그 목적한 죄를 실행에 옮기기 전에 자수한 사람에 대하여는 그 형을 감경하거나 면제할 수 있다.

한편, 항공기에 대한 강도행위는 항공보안법 제40조에 의해 가중처벌되며, 사상의 결과를 발생시킨 경우 형의 양정 및 특별법 우선의 원칙에 따라 강도상해치상죄, 강도살인치사죄가 아닌 항공기 강도치사상죄, 즉 부진정결과적 가중범으로 의율된다. 선박을 강취한 경우에도 형법 제340조에 따라 가중처벌되며 인명피해 발생 시 고의와 과실을 불문하고 항공기 강도치사상죄와 마찬가지로 최소 무기징역에 처한다.

선박 및 해상구조물에 대한 위해행위의 처벌 등에 관한 법률 제6조(선박 납치죄)
① 폭행이나 협박 또는 그 밖의 방법으로 운항 중인 선박 또는 해상구조물을 강탈하거나 선박을 강제로 운항하게 한 사람은 무기 또는 5년 이상의 징역에 처한다.
② 제1항의 죄를 범할 목적으로 예비하거나 음모한 사람은 5년 이하의 징역에 처한다. 다만, 그 목적한 죄의 실행에 착수하기 전에 자수한 사람은 그 형을 감경하거나 면제한다.
제12조(선박 납치 등 살인ㆍ치사죄, 상해ㆍ치상죄)
① 제6조제1항의 죄 또는 그 미수죄를 범하여 사람을 살해하거나 사망에 이르게 한 사람은 사형, 무기 또는 10년 이상의 징역에 처하고, 사람의 신체를 상해하거나 상해에 이르게 한 사람은 무기 또는 7년 이상의 징역에 처한다.
② 제5조제1항ㆍ제2항, 제7조의 죄 또는 그 미수죄(제5조제2항의 경우 폭행은 제외한다)를 범하여 사람을 살해하거나 사망에 이르게 한 사람은 사형, 무기 또는 7년 이상의 징역에 처하고, 사람의 신체를 상해하거나 상해에 이르게 한 사람은 무기 또는 5년 이상의 징역에 처한다.
③ 제8조부터 제10조까지의 죄 또는 그 미수죄를 범하여 사람을 살해하거나 사망에 이르게 한 사람은 사형, 무기 또는 5년 이상의 징역에 처하고, 사람의 신체를 상해하거나 상해에 이르게 한 사람은 무기 또는 3년 이상의 징역에 처한다.
④ 제1항부터 제3항까지에 규정된 죄의 미수범은 처벌한다.

선박 내에서의 강도행위를 가중처벌하는 조항이다. 다중의 위력으로 제6조에 규정된 죄를 범한 때에는 해상강도죄로 처벌된다. 아래 표를 참고하자.
특이하게 선박납치등 살인죄의 형량은 강도살인죄보다 낮은데, 이미 강도살인죄의 법정형이 사형 또는 무기징역이라는 점도 고려하지 않고 일률적으로 살인의 고의와 상관없이 '사형, 무기 또는 10년 이상의 징역'이라는 법정형을 규정하고 있어서 졸속입법이라는 의견도 있다. 물론 같은 법조가 적용되더라도 양형에 있어서 이 둘의 차이는 매우 크다. 전자는 중대범죄 결합 살인이고, 후자는 강도치사인데, 둘 다 선박이라는 특수한 환경이 가중요소로 반영되어 무기징역이 선고될 가능성이 높다.
다만 선박 내에서의 살인죄와 치사 범죄의 처벌 수위가 같은 데에는 일단 선박에서 이런 범죄를 저지른 자가 범행 후에 어떤 일을 벌일 지 예측이 어렵기 때문이다. 그대로 시신을 물에 빠뜨린다거나 하는 식으로 범행을 은폐할 수도 있다는 것이다. 이렇게 되면 어찌저찌 증거를 발견한다고 하더라도 살인인지 치사인지 애매한 경우가 생길 수밖에 없는데, 치사로 빠져나가도 무겁게 처벌할 수 있게끔 조치를 마련한 것이라 볼 수도 있겠다. 물론 진짜로 범행 은폐를 위해 시신을 물에 빠뜨렸다가는 죄질도 나쁜데다 계획적인 살인임을 스스로 인정하는 꼴이라 치사죄로 조금이나마 가볍게 처벌될 가능성마저 사라지고 오히려 형량만 더 늘어난다. 형량은 최소 무기징역, 최대 사형이다.

제5조의2(약취ㆍ유인죄의 가중처벌)
① 13세 미만의 미성년자에 대하여 「형법」 제287조의 죄를 범한 사람은 그 약취(略取) 또는 유인(誘引)의 목적에 따라 다음 각 호와 같이 가중처벌한다.
1. 약취 또는 유인한 미성년자의 부모나 그 밖에 그 미성년자의 안전을 염려하는 사람의 우려를 이용하여 재물이나 재산상의 이익을 취득할 목적인 경우에는 무기 또는 5년 이상의 징역에 처한다.
2. 약취 또는 유인한 미성년자를 살해할 목적인 경우에는 사형, 무기 또는 7년 이상의 징역에 처한다.
② 13세 미만의 미성년자에 대하여 「형법」 제287조의 죄를 범한 사람이 다음 각 호의 어느 하나에 해당하는 행위를 한 경우에는 다음 각 호와 같이 가중처벌한다.
1. 약취 또는 유인한 미성년자의 부모나 그 밖에 그 미성년자의 안전을 염려하는 사람의 우려를 이용하여 재물이나 재산상의 이익을 취득하거나 이를 요구한 경우에는 무기 또는 10년 이상의 징역에 처한다.[10]
2. 약취 또는 유인한 미성년자를 살해한 경우에는 사형 또는 무기징역에 처한다.[11]
3. 약취 또는 유인한 미성년자를 폭행ㆍ상해ㆍ감금 또는 유기(遺棄)하거나 그 미성년자에게 가혹한 행위를 한 경우에는 무기 또는 5년 이상의 징역에 처한다.
4. 제3호의 죄를 범하여 미성년자를 사망에 이르게 한 경우에는 사형, 무기 또는 7년 이상의 징역에 처한다.[12]
③ 제1항 또는 제2항의 죄를 범한 사람을 방조(幇助)하여 약취 또는 유인된 미성년자를 은닉하거나 그 밖의 방법으로 귀가하지 못하게 한 사람은 5년 이상의 유기징역에 처한다.
⑥ 제1항 및 제2항(제2항제4호는 제외한다)에 규정된 죄의 미수범은 처벌한다.
⑦ 제1항부터 제3항까지 및 제6항의 죄를 범한 사람을 은닉하거나 도피하게 한 사람은 3년 이상 25년 이하의 징역에 처한다.
⑧ 제1항 또는 제2항제1호ㆍ제2호의 죄를 범할 목적으로 예비하거나 음모한 사람은 1년 이상 10년 이하의 징역에 처한다.

13세 미만의 미성년자를 이용한 강도행위는 특정범죄 가중처벌 등에 관한 법률 제5조의2 제2항으로 가중처벌되며 법정형은 무기 또는 10년 이상의 징역으로 이는 해상강도상해치상죄와 동일하다. 한편 이러한 미성년자를 약취 또는 유인한 강도가 그 미성년자를 살해하거나 사망에 이르게 한 때에는 강도살인치사죄가 아닌 같은 법 제2항제2호 또는 제4호에 의하여 가중처벌된다. 일반 강도치사와 달리 미성년자 약취유인후 강도치사의 경우는 사형에 처할 수 있다는 차이가 있다.

고의범이자 결합범이다.

4. 설명

강도가 고의로 사람을 죽였을 때 성립하는 범죄다. 이때의 살인은 강도의 피해자로 제한되지 않고, 강도의 기회에 살인한 경우까지 포함된다. 준강도죄의 강도범인을 포함하므로, 따라서 절도범이 범행 직후 경찰관에게 붙잡혀 파출소로 연행되다가 체포를 면하기 위하여 과도로써 경찰관을 찔러 사망케 한 경우나 강도범이 범행 도중 공범을 살해했을 때에도 강도살인죄가 성립한다.[13]

채무자가 빚을 갚지 않기 위해 채권자를 살해하는 경우에도 강도살인죄가 성립할 수 있다. 관련 사건 다만, 채무자가 채무를 면탈할 의사로 채권자를 살해했더라도 일시적으로 채권자측의 추급을 면한 것에 불과하여 재산상 이익의 지배가 채권자측으로부터 범인 앞으로 이전되었다고 보기 어렵다면, 강도살인죄 대신 일반 살인죄가 적용된다. 대법원 2010. 9. 30. 선고 2010도7405 판결

강도살인죄는 현행법상 가장 강력하게 처벌되는 범죄 중 하나로, 법정형이 사형 또는 무기징역만으로 규정되어 있다.[14] 이는 대통령 등을 암살할 때 적용되는 내란목적살인죄와 사실상 형량이 같다. 내란목적살인죄의 경우 법정형이 사형, 무기징역 또는 무기금고이나, 대한민국 헌정 사상 무기금고가 선고된 사례는 단 한 번도 없기 때문에 실질적으로 사형 또는 무기징역이라 보면 된다. 군형법을 제외하고 일반인에게 적용되는 죄 가운데, 강도살인보다 중한 죄는 적국에 합세해서 대한민국에 항적하는 죄인 여적죄(법정형 사형) 뿐이다. 강도살인죄와 법정형이 동일한 죄는 내란수괴죄, 외환유치죄, 강간살인죄, 해상강도살인죄 등이 있다.
